Welcome to Nova Glow Studio, LLC (“Nova Glow,” “we,” “our,” or “us”). These Terms & Conditions (“Terms”) govern your use of our website, mobile communications, online booking platform, memberships, class reservations, recovery services, retail purchases, and in-studio experiences.

By accessing our website, creating an account, purchasing services, booking classes, or attending Nova Glow Studio, you agree to these Terms. Your participation in classes, Recovery Services, events, workshops, or use of Nova Glow facilities is also subject to Nova Glow’s separate Waiver, Release of Liability, Assumption of Risk & Informed Consent Agreement. "Recovery Services" include infrared sauna therapy, red light therapy, halotherapy, chromotherapy, vibration resonance therapy (VRT), heated wellness experiences, and related recovery modalities offered by Nova Glow.

These Terms are intended to be clear, fair, and aligned with the elevated experience we strive to create for every client.

1.     Eligibility

You must be at least 18 years old to create an account, purchase services, or participate in classes or recovery offerings without a parent or legal guardian.

Minors may only participate with prior written consent from a parent or guardian and subject to any additional studio policies.

2.     Reservations & Class Policies

2.1.         Booking & Reservation Policies

Reservations are subject to booking windows, capacity limits, waitlist procedures, reservation cutoffs, cancellation policies, and other booking rules established by Nova Glow from time to time.

2.2.         Arrival Policy

Clients are expected to arrive prior to class start time. For safety and experience consistency, entry may be denied to clients arriving after class begins, and late arrivals may forfeit their reservation and applicable credit.

New clients may be required to arrive early for orientation and equipment instruction.

2.3.         Waitlists

Waitlisted clients may be automatically added into class if space becomes available. Once added to class all cancellation policies apply, including applicable late cancel or no-show penalties.

It is your responsibility to monitor your reservation status.

2.4.         Cancellation & No-Show Policies

Late cancellation fees, no-show fees, forfeiture of credits, and other reservation penalties may apply. Cancellation windows and fees may vary by membership type, promotional offer, or service category and are subject to change.

Applicable cancellation policies will be disclosed at the time of booking, within your membership agreement, or within the booking platform, and are incorporated into these Terms by reference. The booking, cancellation, waitlist, and no-show policies presented at the time of booking shall control in the event of any conflict with these Terms.

Late cancellations and no-shows may result in forfeited class credits, monetary penalties, temporary booking restrictions, or suspension of booking privileges.

2.5.         Private Sessions

Private sessions may require longer cancellation notice periods and may be charged in full if canceled late or missed.

2.6.         Changes to Policies

Nova Glow reserves the right to modify booking windows, reservation limits, waitlist procedures, cancellation policies, fees, studio rules, and operational procedures at any time.

3.     Memberships & Packages

3.1.         General Terms

Memberships, class packages, promotional offers, and recovery packages are non-transferable, non-shareable, and non-refundable except where required by law. Unused classes or services expire according to the terms disclosed at purchase.

3.2.         Billing Authorization

By purchasing a membership, package, or service, you authorize Nova Glow Studio and its third-party payment processors to store your payment method and charge all applicable fees, including recurring membership charges, late cancellation fees, no-show fees, retail purchases, and outstanding balances.

You represent that you are authorized to use the payment method provided, all billing information submitted is accurate and current, and you will promptly update any expired or invalid payment information.

If payment cannot be successfully processed, Nova Glow reserves the right to suspend booking privileges, deny entry to classes or services, or terminate memberships until outstanding balances are resolved.

3.3.         Auto-Renewing Memberships

Recurring memberships automatically renew until canceled in accordance with the applicable membership terms. By enrolling in a recurring membership, you authorize Nova Glow to charge your payment method on a recurring basis until cancellation.

Cancellation requests must be received prior to the next scheduled billing date to avoid renewal charges. Cancellation requests must be submitted through approved channels, which may include the Nova Glow website, mobile application, or customer account portal, subject to the terms of the applicable membership agreement.

3.4.         Failed Payments

If a payment method fails we may retry payment, suspend booking privileges, or terminate membership access until payment is resolved.

You remain responsible for all outstanding balances.

3.5.         Membership Freezes

Membership freezes may be offered at Nova Glow’s discretion and subject to applicable policies, fees, minimum terms, or documentation requirements.

3.6.         Chargebacks & Payment Disputes

Clients agree not to improperly dispute or charge back legitimate charges.

If a chargeback is initiated for a valid charge, Nova Glow reserves the right to: suspend or terminate account access, revoke memberships or class credits, recover associated fees and costs, and pursue collection of unpaid balances to the extent permitted by law.

4.     Studio Etiquette

Nova Glow is committed to maintaining a safe, respectful, and welcoming environment free from harassment, intimidation, discrimination, or disruptive conduct. To maintain a calm, elevated, and respectful environment:

Clients agree to:

  • treat staff and fellow clients respectfully,

  • follow instructor guidance,

  • maintain appropriate hygiene,

  • wear required grip socks when applicable,

  • and refrain from disruptive, unsafe, discriminatory, threatening, or inappropriate conduct.

Nova Glow reserves the right to deny service or terminate access to any client whose behavior negatively impacts the studio environment or safety of others.

Class capacities are intentionally limited to support safety, comfort, equipment spacing, and overall experience quality.

5.     Recording, Photography, Social Media & Privacy

To protect the comfort and privacy of our clients and instructors, recording within the studio is prohibited without prior consent from Nova Glow. This includes video recording, audio recording, photography, livestreaming, and social media broadcasting. Clients may not record classes, instructors, staff, or other guests without permission.

Nova Glow may occasionally capture photography or video within the studio for marketing and social media purposes. By entering the studio, you acknowledge that incidental inclusion in studio content may occur. If you prefer not to appear in marketing content, please notify staff.

6.     Right to Refuse Service

Nova Glow reserves the right to refuse service, suspend access, remove clients from class, or terminate memberships where necessary to protect client safety, preserve the studio environment, enforce studio policies, address payment issues, or respond to disruptive, harassing, unsafe, discriminatory, threatening, or otherwise inappropriate conduct.

7.     Infrared Sauna & Recovery Services

Recovery services, sauna sessions, and wellness offerings are subject to availability, scheduling requirements, and studio policies.

Clients are expected to follow all posted instructions and staff guidance when using recovery services or studio amenities.

Nova Glow reserves the right to modify, suspend, or discontinue services or amenities at any time.

8.     Personal Belongings

Lockers and storage areas may be provided as a convenience only. Nova Glow is not responsible for lost, stolen, or damaged personal property. Clients are encouraged to leave valuables at home or secured in their vehicles.

9.     Retail Purchases

Unless otherwise stated, retail purchases may be exchanged or returned for store credit within the applicable return window, provided items are unused, unworn, unopened, and accompanied by proof of purchase. Certain products, consumables, sale items, or promotional merchandise may be final sale.

10.  Website & Intellectual Property

All website content, branding, logos, photography, graphics, text, class names, marketing materials, and studio content are owned by Nova Glow Studio or used with permission. You may not reproduce, distribute, modify, copy, sell, or commercially use any content without prior written consent.

11.  Electronic Communications & Signatures

By creating an account, booking services, signing waivers electronically, or otherwise interacting with Nova Glow digitally, you consent to receive electronic communications and agree that electronic agreements, waivers, acknowledgments, and signatures are legally binding and enforceable to the fullest extent permitted by law. Consent to receive marketing communications is not a condition of purchase.

By opting in to receive text messages from Nova Glow, you agree to receive recurring automated and non-automated messages related to:

  • booking confirmations and reminders,

  • waitlist notifications,

  • membership and account updates,

  • customer service communications,

  • promotional offers,

  • event announcements,

  • and studio news.

Message frequency may vary based on your activity and interactions with Nova Glow.

Message and data rates may apply. Charges are determined by your mobile carrier and are your responsibility.

You may opt out of SMS communications at any time by replying STOP to any message. After opting out, you may receive a final confirmation message. To re-enroll, follow the applicable opt-in process.

12.  Third-Party Platforms

Nova Glow uses trusted third-party providers for booking, scheduling, membership management, payment processing, communications, analytics, and related operations. Your use of certain features may also be subject to those providers’ terms and privacy policies. Nova Glow is not responsible for third-party platform outages, interruptions, or independent practices or policies.

13.  Disclaimer of Warranties

Services, website content, and studio facilities are provided “as is” and “as available” without warranties of any kind, express or implied.

Nova Glow does not guarantee uninterrupted service, availability of instructors, or availability of particular classes or amenities. Schedules, instructors, offerings, and services may change at any time.

14.  Limitation of Liability

To the fullest extent permitted by law, Nova Glow shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from:

  • use of the website or mobile application,

  • scheduling interruptions,

  • booking platform outages,

  • technology failures,

  • or temporary unavailability of services.

Nothing in these Terms limits liability that cannot be limited under applicable law.

15.  Indemnification

You agree to indemnify and hold harmless Nova Glow Studio and its affiliates, owners, employees, contractors, and representatives from claims, damages, liabilities, costs, and expenses arising from your use of the studio, violation of these Terms, misconduct, or violation of applicable laws or rights of third parties.

16.  Governing Law

These Terms are governed by the laws of the State of Colorado.

Any disputes arising from these Terms or your use of Nova Glow services shall be resolved exclusively in the state or federal courts located in Colorado, unless otherwise required by applicable law.

17.  Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

18.  Changes to These Terms

Nova Glow may update these Terms periodically. Updated versions will be posted on our website with a revised effective date. Continued use of Nova Glow services after updates constitutes acceptance of the revised Terms.

19.  Force Majeure

Nova Glow shall not be liable for delays, interruptions, closures, or inability to provide services resulting from causes beyond its reasonable control, including but not limited to acts of God, severe weather, power outages, public health events, governmental actions, labor shortages, technology failures, or other unforeseen events.
